JUDGMENT FOU PLAINTIFF. At the Eltham Magistrate’s Court yesterday, Mr. 11. W. Tate, S.M., delivered his reserved judgment m the Ngaere motor collision case, in which Arthur \V. Lowe, of Pukengahu, sought to recover from Edward Maslin, carrier, of Eltham, the sum of £l2O. Mr. Tate said there was no question about the negligence.ol the defendant. The time at plaintiffs disposal to make up Ills mind as to the best course to pursue, immediately prior to the collision, was very short, and lie acted to the best of liis judgment. Whether Lowe did right or wrong in taking the incorrect side of the road was governed by the circumstances, and lie considered that plaintiff was not guilty of contributory negligence. Judgment would be for plaintiff for £SB 10s (repairs £3B 10s, deprivation of use of car £lO, depreciation £10) and costs £8 12s.
