BLACK AND WHITE CABS. WRIT OF ATTACHMENT TO BE ISSUED. (11Y TISIiKGRAI’H —PIIEBS ASSOCIATION.) WELLINGTON, Oct. 12. Reserved judgment was delivered today by Mr. Justice MacGregor in an action in which the Blflck and Wllito Cabs, Ltd., sought for leave to issue a writ of attachment against Edward Sandford for failing to obey a writ ot injunction directed against him m regard to a car so painted as to resemble Black and White cabs. Since the judgment, the defendant had altered tlie painting of his car in some respects, but Mr. Justice MacGregor, after inspecting the cabs, holdts that the defendant has not followed the course recommended by Mr. Justice Alpers. Defendant, he say.s, lias not honestly tried to obey the order of the ourt, but still remains determined _ to sail as close as possible in imitating Black and White cabs. Defendant’s car still remains calculated to deceive. He holds that defendant has not obeyed the order, either in the letter or in the spirit, and is accordingly guilty of contempt. He ordered that the plaintiff company had leave to issue a writ of attachment, but in order to give Sandlord a final onpqrtunity of complying witli the terms of the injunction the writ would lie in the office of the court for 14 days. CREDITOR’S PROOF OF DEBT. ilr. Justice MacGregor also delivered judgment upholding the decision of the Official Assignee in rejecting proof of debt for £73 in nection with the bankruptcy of Abraham Spiro, caterer, purporting to he money’advanced by daughter to father for business purposes. He said“lt appears this alleged cash hook was not entered up from day to day, nor was it in any real sense a contemporary record at all, like receipts. The entries relating to advances alleged to have been made in 1923 and 1924 were actually made in 1927, and were then recorded in contemplation of, and no doubt in preparation for, the impending bankruptcy of the debtor.
