BANISHMENT OF SAMOAN CHIEFS IMPORTANT QUESTION FOR DECISION. (BY TELEGRAPH —PRESS ASSOCIATION.) WELLINGTON, Sept. 22. The Appeal Court assembled to-day for its jkuul session this year. Sir William A. Sam took the place of Clnel Justice and the others on the Bencth were then- Honours Mr. Justice Herdmain, Mir. Justice Reid, Mr. Justice Adams, and Mr. Justice Ostler. Seven cases were .allotted dates and •applications were made for leave to appeal by seven convicted persons who were not represented. The court said it would investigate them. Sir John Findlay, in asking for a fixture before the Full Court for leave to appeal against the conviction, of three Samoan chiefs for a breach of a banishment older made by the Samoan Court, stated that the ease was intricate and an important one, as the appellants called the validity of the Samoan Act 1921, under which the banishment order was made, into question. The substantial question for argument was whether this Act was ultra vires qf the New Zealand' Legislature and this involved questions relating to the constitution of New Zealand. This case was set down for October 10. The court adjourned till to-morrow.
