STALLION OWNER’S CLAIM.
QUESTION §F REDUCED FEE
A case of interest to horse owners and farmers was decided yesterday in the Magistrate’s Court by Messrs.. G. A. Burgess and R. W. J- McNeill, J’.P., when Jeremiah Kerris* sued John Sheahan for the sum of £4 4s, balance of an account for service' fees. The facts as set out bv counsel for plaintiff (Mr. W. Brown) were that The horse was taken to defendant’s place by plaintiff’s groom. Two mares were served, the second not belonging to defendant but to his brothers, but the oroom alleged he arranged for a fee of £8 8s for the two, this being a rechiced amount because of tbe double service on the same place. This defendant denied, and. said he had had no authority from hisi brothers, hut had paid for the one mare belonging to him. After considerable evidence bad been adduced tbe Bench gave judgment for plaintiff for the sum claimed 1 (£4 4s) and costs £1 16s, basing the decision •on the fact that the acceptance of a lower fee for the two mares proved l a contract made. Having given authority, defendant had made himself liable for the fee for the two mares.
