Judgment in the case in which the number of storeys in the 'Lrocadero Hotel was in •dispute was given to-day by Mr. Justice Alpers. In reviewing the evidence, .his Honour mentioned thiait the case was an extraordinary one, defendant having gone in for a contract involving £4O,DUO without inspecting the building, even though he had resided at an hotel next door to the Trocadero for four or five days. His Honour thought the building one / of five storeys, but thought ,the statement should be qualified An some such way as to make it clear that the eovered-in portion on the top was not so 1 much as that of the other storeys. He thought the item in the agent’s memorandum an innocent njisrepreserotation, and that if the defendant did not succeed on those grounds he would on a common mistake. It was quite true that the .purchaser had largely himself to thank for the present litigation, and while the way he entered into the deal was a piece of folly on his part, that did not prevent him from going to the court. He thought plaintiffs must fail in their prayer for a decree for specific performance. Costs were allowed on the highest scale, with two extra days at 15 guineas.
