That the private report of a medical officer cannot be withheld as evidence in a court of law was the decision ot Mr. S. R. Bartholomew, S.M., during the hearing of a civil case at the Dunedin Magistrate’s Court. Dr. Rogers, house surgeon at the Dunedin Hospital, was giving evidence as to the injuries received by the plaintiff, who had been knocked down by a motor car. Mr. J. : N. Thompson, counsel for the plaintiff, after questioning the witness, asked that he might be allowed to see the latter’s notes on the case, but was met with a refusal from the doctor, who said that the notes were the private property of the Hospital Board, and that it was not permissible for him to hand them in as evidence. “The Hospital Board is a public institution,” observed his Worship, “and there is no reason why this report should not be shown to the court, although not necessarily for publication. Nothing is privileged so far as the court is concerned.” The notes were then handed in, and counsel proceeded to cross-examine the witness on them.
