Several of the passengers from Frankton to Auckland by the daylight limited express -will have difficulty in identifying their luggage (remarks the “Auckland Herald.' 1 ) One of the trucks of luggage waiting to be placed aboard the train iat Frankton was apparently left, standing too close to the edge of the platform, and as the train drew in three of four suitcases were thrown across the platform and under the wheels of the train. The suitcases were torn to ribbons, and to the amusement of the spectators, boots and shoes, articles of clothing and underwear, tooth-brushes, hair-brushes and toiletware of every description were strewn along the' line in profusion for a distance of three or four carriage lengths. The debris was quickly gathered j together in one heap and placed aboard' the train'to be brought to Auckland. In the claim of William George Collins for £607 from Dr. Herbert Charles Faulke, on the grounds of defendant’s alleged negligence in the extraction of a tooth, thereby breaking plaintiff’s jaw and causing septic poisoning, was concluded on Thursday in the Supreme Court at Wellington before Mr. Justice Macgregor. His Honour found that the doctor was not negligent, but that plain* tiff was himself negligent in not following out the defendant’s instructions. Although unusual, the breaking of the jaw was always liable to accompany the extraction of teeth. Sepsis, His Honour said, was in the tooth and jaw at the time of the extraction. The verdict was for the defendant, who did not press for the costs of the action. —GPress Assn.
