JUDGMENT FOR SIXPENCE.
COURT COSTS TOTAL 15s. CIVIL CLAIM AT MANAIA. As a result of the decision of Mr. R. H\ Tate, S.M/, at the Magistrate’s Court" at Manaia to-day, alter the hearing of a claim for recovery of 6s 6d, Allred Percy Edwards, a farmer, late of Kaupoaonui, had judgment given against him for the sum of sixpence in favour of Alfred Henry Yarrow, baker and confectioner, of Manaia He was ordered to pay fifteen shillings costs. According to evidence given by both parties, and an outline of the case by Mr. Lawrence, who appeared for plaintiff’. the defendant, while a resident ol the Glenn Road, had bread delivered for hihi at the dairy factory to which he supplied his produce. In July, 1925, he leit the district, and before doing so paid an account to Air. Yarrow. The receipted account produced proved that it was made out on July 1 for bread delivered daring the previous month. The plaintiff regularly forwarded an account for 10s 6d to defendant for bread delivered during July, but no payment was made. Some months ago, acting under plaintiff’s instruction, the latter’s solicitor forwarded a demand for payment of the account, together with the legal fee of six shillings. Defendant subsequently paid ten shillings to plaintiff, who paid his solicitor his fee out of it. Further demands for defendant to pay the remaining 6s 6d had no results. The Magistrate held that legal fees for letters sent prior to an action could not be claimed, and accordingly gave judgment as above.
