CLAIM FOR ALLEGED LIBEL. (BY TELEGRABti— PRESS ASSOCIATION.) WELLINGTON, Dec. 9. Arising out of certain allegations in an open letter that appeared in the publication Critic, Mr Howard Elliott filed a claim in the Magistrate’s Court recently to recover £2OO damages for alleged libel, on the ground chiefly that the letter implied that he carried an automatic in his pocket. When the case was mentioned to-day before Mr Riddell, S.M., counsel for the defendants said that Mr Elliott had filed notice of discontinuation. Defendants had applied to have the matter dealt with in the Supreme Court so that the truth or otherwise could he ascertained. Defendants asked for substantial costs, , as considerable trouble had been gone to in preparing a defence. This was opposed by Mr Boys, for Mr Elliott, who said he was prepared to pay a. reasonable amount in view of the fact that he had the action discontinued. Mr Riddell allowed £3 3s.
