MAGISTRATE’S COURT.
SITTING AT MANAIA. __ The monthly sitting of the Magistrate’s (Jo ur c at Manaia was held today, Mr. R, W. Tate, S.M.. presiding CIVIL CLAIMS. Judgment was given by default m favour of the plaintiff, with costs against the defendant, in the folio vj ncr civil claims: Cbmmissioner oil Taxes v. William John Atkinson, £2- -is I 10d (costs 15s) ; Manaia Town Board v. Mrs. Whare Rei (separate estate), 12s Id (costs 8s)-. On a judgment summons, \Y. toutton, who did not appear, was ordered to pay £2 7s lid to- Waiter Lowery forthwith in -default two days’ imprisonment. , ~ , Raiigi Katene, from whom Alexander Henry Christie claimed the return ot £2, being a loan of £1 12s 6d with interest for two years (is 6d), disputed the claim. . After plaintiff bad stated his case, the magistrate remarked that defend•vnt appeared to have a. short memory. Plaintiff, through his counsel, Mr. A. G. Bennett, Intimated that he _ was prepared to forego interest, and judgment was entered by default for plain:ff f or £1 12s 6d with costs 16s. j SPEEDING AROUND A CORNER. Man lice Graham, ia mechanic of Hawera, was charged with driving a motor :ar ,around the corner of the Manaia and Main South Roads at a speed dangerous to the public. ■ . Defendant did not appear, but his employer, the local agent of Treloars. I Ltd., was present on his behalf, ana entered a plea of guilty. Constable J. Scamidi sai<l that at about 2.30 o’clock on the afternoon of October 8, the defendant drove around the corner to the main street of the J town at a speed of about 2o or 30 miles I per hour. This speed was dangerous, the car turning the corner on two wheels. Defendant’s employer said that Graham had been in <a hurry to get a part for a milking machine from Hawera
in time for milking. 1 In entering a conviction, the. magistrate remarked that no burry justified a motor driver turning a corner at such a speed. A fine of £l, with cost 7s, was imposed. UNLIGHTED MOTOR CYCLE.
Arthur Elkington, a native farmer of Kaupokonui, pleaded guilty to a charge of riding a motor cycle along Main Street, Manaia, on the evening, of October 30 without a, light. Constable Scannell explained that the offence had occurred at about seven o’clock on the evening in question. Defendant stated that 'his lamp, which was of the acetylene type, had been burning when he entered the town. He had been unable to se whether it was out or not on account of the street lights. , , 0 .. Questioned by Constable Scannell, defendant admitted that he did not stop immediately lie noticed that the light had gone out. . , Ra;ngi Katene stated that lie had seen the defendant just after he had entered the town and his light had appeared dim. He could not be sure that it was burning. Defendant said he thought that the lamp had failed owing to some defect The magistrate intimated that he would not" inflict a. heavy penalty, m order that defendant- would have an opportunity to have his lamp repaired. fine of I.os, with 12s costs, was entered <
