Alleging that the Magistrate gave judgment for the respondent lady, Mildred Hogg, against the weight of evidence and that- witnesses gave false testimony, David Hamilton Hogg lodged an appeal, which was heard by Mr. Justice Herdman at the Supreme Court at Auckland yesterday against the seperation and maintenance orders which were granted on the grounds of alleged persistent cruelty and failure to maintain. Respondent gave evidence that she left her husband after 22 years of married life, because she was hourly in fear of being killed, as he always threatened to do for her and the three children. The latter, who were over sixteen years of age, had often to protect her from attacks with an axe and a knife. His language was vile and he had told witness that he had had to plant his razor because he was afraid of himself. The long list of allegations were refuted by appellant, to whose pleasant disposition a number of witnesses bore testimony, but the Judge was of opinion that cruelty had been proved.— Press Association.
