Mr E. Page, S.M., in the Magistrate’s Conrt at Wellington, held that a landlord was not entitled to recover possession of premises l when rent was in arrear unless notice had been given. F. Smith had let a shop and dwelling to. R. Lancelv at £3 a week. Three months later the rent Wa!s £lB in arrear, and plaintiff issued a summons for possession. Mr Page said that section 170 of the Magistrate’s Court Act only applied in cases where the landlord had the right- by law to reenter for non-payment of. rent.
