Whether the Education Act prejudices uni married mlale or female teachers in obtaining appointments was a, question placed before the Supreme Court when the Educational Institute sought ia, cleclailaitory judgment, the defendants being the Wellington ami Otago, Education, .Boards. Mr. justice AlcGregor was the prasnding judge, Air. Evans appeared lor the plaintiff, All 1 . Misilop for the Wellington Board, Air. Flair for the Education Minister ami the Otago I ioard. The plaintiff asked the Court to answer a, ksenios of queistiomsi regarding the powers of boards to give preference or refrain from appointments in view of cenbain 'sections of t)he Act. Counsel stated that the object of the proceeding was to aisk the 'Count- to 1 decide wliether married teachers: and ummiarnied teachers were, la® a, class, to be denied the opportunity of competing for - positions in the service. lie saicl they were denied that opportunity by the present practice of hoards, Mr. Justice McGregor raised the following questions: (Ij Whether the Institute had any istatus to take, proceeditiigs; (2) whether the plaintiff had any interest ini the const ruction of the ‘Act and regulations, iso an to entitle if to issue originating .summons; (3) whether in the diiscyetiom of the Court it ishould in isiiich circumstances answer the questions. Hisi Honor remlarked that the institute seemed to, he a, purely voluntary body. Air. Evans .said it was, ait any rate, the mouth-piece. of .the iteoalieiis.
