SEQUEL TO ADVERTISEMENT PARTIES IN COURT. Tn the Now Plymouth Magistrate's Court yesterday, before Mr. A. M. Mowleni, S.M., ‘ Charles Bounington, a surveyor’s assistant, sued Captain Henry Cooper, now of New Plymouth, for alleged breach of contract, and, alternatively, on the grounds of alleged fraud. In the “wanted’’ columns of a Weil inylon newspaper on /-me 5 last appeared the following advertisement: Wanted. —Smart*single man, with small capital, desirous of expanding experience with established veterinary surgeon: excellent prospects and remuneration. Particulars, Scotch Registry, 208 Lambton Quay. Three days later Bonniugton handed over £IOO in cash to Captain Henry Cooper, now of New Plymouth, witn whom, in the interim, ho had reached a partnership and tutelage agreement. The prospects and remuneration did not pan out as expected, and as a re suit Bounington claimed from Captain Cooper the sum of £I2S 345. The defendant, said Mr. Freeman, had represented himself as being i?. practice in Palmerston North, in receipt of between £2O and £3O a week and being well and favourably known as a veterinary surgeon in the Man • watu district, with the result defendant had put £IOO into his business m cash, on these representations, to find subsequently there was nothing doing He was now claiming to recover toe amount with £2B for loss of time whilelie was working with the defendant. After evidence had been heard, Mr. Freeman said it seemed that the defendant was going to deny the allegation of drunkenness made by the plainriff. He intended to bring evidence of this at a later stage, and at that stage the plaintiff would elect to accent a nonsuit. Plaintiff was nonsuited on his own application, the defendant being allowed solicitors’ costs amounting to £•'• Ss and witness’ expenses 10s.
