WRIT DISMISSED

(BY TELEGRAPH PRESS ASSOCIATION ) ' PALMERSTON N., Nov. 13. Mr. P. L. Hollings, the unsuccess-' fu] Nationalist candidate for the Mauawatu seat, applied in the Supreme Court to-day for a writ of mandamus on the returning officer to declare him elected unopposed. He alleged that, , according to the Act, by the tenth day following the issue of the writs all nominations of candidates should have been entered. On the occasion under review the plaintiff’s nomination was submitted on October 23. the due date' being October 25 (a S-unday). The nominations of the other two candidates were not. submitted in the time prescribed by the statute, the fact of Labour Day succeeding the due calendar date making each 24 hours late of the extended time provided by the statute. In a lengthy legal argument before Mr. Justice Ostler, plaintiff contended that the application of the Acts. Interpretation Act threw the provisions of the legislative statute out of gear. ‘ ‘The only escape from such a dilemma,” he "said, ‘‘is to reject the Interpretation Act in favour of the Legislature Act, making the last day for. nominations October 25.”

The judge said section 25 of the Acts Interpretation Act provided that if the stipulated time expired on a holiday it should be extended for a day after that. It would seem to be a scandalous tiling to be deprived of the right to nominate a candidate.-and the object of the Act was to provide for the next day, which had been saved for them. He dismissed the application with costs £5 ss.
