CHARGES DISMISSED. (BY TELEGRAPH PRESS ASSOCIATION.) GISBORNE, Nov. 2. In a case in which three men, Reginald Edward Clark, Thomas Hyde and Frederick Averkiff. were charged with the theft of 20 gallons of benzine, the property of the Government, and with setting fire to a motor lorry, Detective McLeod, in giving evidence regarding the investigations in connection with the fire, stated that had Clark told him he had reported the matter to the lorry driver the case would not have been brought. The detective blamed the lorry driver for not reporting the matter. The accused had reported the matter as soon as it happened. Counsel for the defence said that the accused had merely done what any motorist would have done, borrowed some benzine, and were prepared to pay for the damage accidentally caused. The Bench stated that the case had been a very unfortunate one. The evidence clearly showed that there was not any criminal intent. The.case was therefore dismissed.
