Received Oct. 9, 1.10 p.m. WASHINGTON, Oct. 8. General Mitchell, assistant chief of the Army Air Force, summoned to appear before the Naval Board now investigating the Shenandoah disaster to give an explanation of his statement that the disaster could, have been avoided, refused to testify, on the grounds that it was inconsistent with his legal rights while courtmartial proceedings are pending by the War Department, and that testimony at these proceedings might jeopardise his case. —A.us.-N.Z.
