A verdict was returned for the defendants in the brown heart case. • Aus.-N.Z. Cable Assn. [ln the above-mentioned case-, Bradlev and Sons', Ltd., of Covent Garden, claimed £4314 from the Federal Steam Navigation Company, owners of the Northumberland, owing to development of brown heart in. ajiples shipped on the Northumberland from Hobart in April. 1021. The main issue of the case was the plaintiffs allegation that brown heart was due to bad ventilation in the Northumberland’s hold. The defence was that the brown heart was due to inherent defects in the apples when shipped. The defendants alternatively pleaded that the apple eases were msnflieintly ventilated, and was also reiving on the exceptions set out in the bills of lading relating to the perils of the sea as giving the owners immunity from responsibility in the event of reasonable means having been taken to provide against a ship’s defects and nnseaworthiness.]
