WELLINGTON, July 3. pile charge against Noel Lyons, the young Australian seaman, of tailing to obev the order of deportation issued b\ the” Attorney-General (Sir Francis Bell) on May 26* last was heard in the Magistrate’s Court this, afternoon. The rear of the court was crowded, the majority of the onlookers being water■slders and seafaring men. The prisoner pleaded guilty. The magistrate said: “You appear to have made up your mind to flout the order, which is the working of the law. No court can stand-for that sort of thing. You have one appeal, and that is the Legislature That is the only way in which you can get the Actrepealed. The "only person who can upset the order is the Attorney-Gen-eral himself. I consider no court has power to override the order. I. regret you do not accept the opportunity of acting in compliance with it. “I have one duty to perform,” added the magistrate. “I must do it. You know what the consequences are. Are you prepared to use the opportunity if it is given to you now?” Lvons: “I think that it is only drawing the matter out. I considered it long ago.” The magistrate: “Very well; you will be convicted and somite need to nine months’ imprisonment with hard labour.” It was stated that a large quantity of I.W.W. literature was found in the possession of Lyons. The town of Bluff had been placarded with this literature. When the captain on the Manuka refused to alter the menu accused had induced the men to go slow. When the crew were re-engaged at Wellington Lyons was excluded. He caused further trouble, and he was deemed an undesirable and was ordered to leave New Zealand. He refused to leave, and the present proceedings were taken.
