INTERESTING POINT DECIDED (BY TRI.RURAVH VRF.BH ASSOCIATION. ASHBURTON. April 2-1. Mr. E. I), Mosley, S.M., gave written judgment in the case Digby v. Stephens which was heard on April 3. ‘The claim was for £3 3s, and the issue was whether a trainer can pledge an owner’s credit lor stabling a horse and for the trainer’s keep. The magistrate said it was clear from the evidence that a contract was made Itv Vingam nd Stephens (the trainer), and the plaintiff looked to Vingam to pay. At the time the contract was made plaintiff seemed to have failed to make anv inquiries as to the ownership of the horse, and to have been quite satisfied to look to Vingam for payment. The only grounds on which action could he sustained against Stephens was that Vingam acted as his agent or steward and had expressed or implied authority to pledge his principal’s credit. It was clear from the evidence that Vingam had no express authority. As regards implied authority the magistrate said lie was entirely unable to assume that it must be taken as common knowledge that trainers have authority to pledge an owner’s credit for loose boxes and hoard, nor was hb from which, implied authority might he aware that any such custom existed from which implied authority might be deduced. Judgment was given for defendant with £5 17s costs. “My opinion,” said the magistrate, “is that ah honest man lias been taken down, and T would have liked to give judgment in his favour if l could.” HA MILTON ACCEPTANOES.
