WELLINGTON, March 26. The hearing is proceeding of a case begun in the Supreme Court, in which John Quirk, hotelkeeper, of Taihape, is suing Dwan Bros., hotel brokers, for £2500 and interest from June 17, 1919. Plaintiff claimed thgt the defendants were verbally employed by him as.his agdnt to buy for him the Gretna Hotel property, Taihape, and did so for £30,000, but retained £2500 represented by a promissory note, which he had since paid. , ■{..« A Defendants claim they were agents of the owner, and sold the property to Quirk, . Their commission was. £2500, and the plaintiff knew and approved of their receiving it. In the alternative, if it were proved that the defendants were employed by the plaintiff, they counter-claimed for £3OOO as commission, and for their services in procuring and guaranteeing loans, and generally in arranging plaintiff’s finance. -
