BIRTHDAY CAKE.
/ A WANGANUI COMPETITION. \ BREACH OF GAMING ACT. (by TELEGRAPH PRESS ASSOCIATION.) WANGANUI, March 9. To mark the fourth anniversary of the D.I.C. operations in Wanganui, the manager conceived the idea of a fourtier birthday cake, to be given as a prize to the purchaser who held a certain receipt number during the summer sale. The manager, Mr Herbert C. _Has- ■ sail, was charged at the court with a breach of the Gaming Act. An assistant who sold tickets to two constables were also charged with a similar offence. The defendant pleaded that he did not know it was contrary to the Act, and stated he closed the competition a week earlier' when he was warned by the police. , , The magistrate (Mr J. S. Barton) said that there was no excuse for any responsible business man saving be did not know, esnecially after the publicity given to (he Collinson and Cunningliarne ease. He took into account the fact that the defendant was genuinely surprised to learn that his interpretation of the law was wrong, and that the scheme was not conducted for his personal train. Defendant was convicted and fined £lO, the charge against the assistant being withdrawn.
