MORTGAGEE’S CLAIM.
ALLEGED REMOVAL OF SECURITY PARTIES IN COURT. The -hearing of a claim by James Patched, retired farmer, against. A. C. * Pease and J. K. Richards, tor the value of materials alleged to be wrongfully removed, from a. farm at Meremere, was commenced at the Hawera Magistrate's Court yesterday afternoon. The • State Advances Superintendent- was r also joined as co-defendant, but it was explained that this had only been done to bring him into the proceedings, ; > as he had not consented to being joined as a co-plaintiff.' ' 'i ■ Mr. L. A. Taylor, for the plaintiff, said his client was the second mortgagee of 192 acres at Meremere, the title of which was a lease undef- tie West Coast Settlement Reserves Act, 1892. That Act gave the tenant the perpetual right of renewal- over the, land, and also . gave the tenant the ownership of all improvements. The State Advances Superintendent was the first mortgagee, and at a. certain stage in various assignments Patched became the owner of the term of years. In the course of time Pease appeared on the title as mortgagee ox the lease, his mortgagor being one Harrison. Certain farm materials namely, tanks, galvanised piping, and water troughs, were removed from the land, and plaintiff contended that these articles had become part and parcel qf ’-the freehold, and were; in fact, part of his security. . Mr. Houston conducted the case forthe defendants Pease and \ Richards, and . when the court rose the hearing was adjourned. ' -
