ACCIDENT TO PAKEHA.

COURT’S FINDING,

WELLINGTON, Feb. 7
The finding in regard to the accident to the Pakeha on June 3, at the Bluff, was delivered to-day. The Court found that it was impossible to say the, exact causes which contributed' to the steamer touching, but the low state of the tide, the position of the vessel in the channel, the draught, and list of the sliip, and probably a slight range, were the factors. The Harbour Board ’s denial of the possibility of such an accident cast upon it the onus of proving that it was impossible. In the circumstances the Court is unable to accept as conclusive the statement that no obsruction existed in the channel near Mararoa Rock. The master and officers exercised all reasonable care, and the pilot was acting to the best, of his knowledge and ability.
An*order was made that the assessor and witnesses’ expense s be borne equally bv the Marine Department and the Bluff Harbour Board.
