.T.UDGMENT FOB- PLAINTIFF
In this case, heard at Eltham before the holidays, the Magistrate (Mr. M. Mowietn, S.M.)' has given his Reserved judgment. . On August 24, 1924, a collision occurred on the Mountain Bead near the Salvation Army Boys’ Horne, Eltliam, when a motor cycle ridden by the plaintiff, E. Loye, of Eltham, labourer, collided with a motor-cycle ridden by the defendant, W. Boon, of Stratford-, builder’s assistant. Plaintiff claimed £2OO damages, and defendant counterclaimed far £4B damages. The Magistrate found in favour or the plaintiff, awarding him £BB damand dismissed the defendant’s counter-claim. Costs were awarded plaintiff on his claim. At the hearing Mr. P. O’Dea appeared for the plaintiff, and Mr. F. C. Spratt for the defendant.
