TROTTING CASE
AN INTERESTING POINT. (BY TELEGRAPH PRESS ASSOCIATION .) WANGANUI, Jan. 12. At the court the reserved judgment was read in the case of tlie police against William P. Case.», u... was charged with disposing of a ticket in the Port Nicholson art union to Sergeant Sivyer, Dy which Sivyer was permitted to have an interest in a scheme whereby a prize of \ a motorcar might be competed for by mode oi chance. The information was laid under the provision of the Justices of the Peace Act, 1908, and the offence charged by section 41, sub-section 13 oi the Gaming Act, 1908. On the tickets it was set out that prizes of oil paintings to the value of £3O would be given, and on the back of the ticket were the words: “Turkish Baths are prepared to exchange for the oil painting the latest model Ford touring car, valued at £163.” In the evidence it was shown that the defendant called out many times: “Here you are: a motor-car for one shilling.’’
The magistrate was of opinion that a clear prima facie case of the sale of a ticket in a lottery, in breach of section 41 of'the Gaming Act, 1908, had been made against Casey, who was convicted and fined £25. Notice of appeal was given.
