“ONE OF FEW.”
PROPERTY DEAL FALLS THROUGH. “I am of opinion that it is one of that class of cases, of which there are few, in which the Court should) not compel the buyer to purchase the land, but as he had broken his bargain to purchase I think some damages should be awarded to, the seller for compensation,” said the Chief Justice (Sir Robert in the Supreme Court after reviewing a case dealing with an altered decision to purchase two properties situated in Wright street, which was made the basis of a claim by Herdman Otto Manz, fanner,, of Otaki, against Samuel Charles Mayall for specific performance and. £IOO damages. His Honor went on to state that there \vere no damages proved, because it was assumed that the property was worth the money mentioned in the offer. There could not' therefore, be any general damages on the ground of decline in the value of the property. His Honor dealt with the email items of expenditure as the only, ground on which damages could, be claimed, and expressed the view that he ought to consider the position in which defendant had been placed by an agent undertaking to find money for him which he was unable to do. Judgment was given for plaintiff for £lO in all.
