Osborne, J's.P., charges of a .breach of the peace were t iret'ei:.ed against ’xiiomns Malcolm and julward \\ in. Richmond. Sergeant Jaenry prosecuttd. Constable O. Tpciter,. in giving evidence on each of the two charges, said that at about- 4 p.m. on Saturday afternoon, aiter the .football match, lie saw the two defendants, fighting in Camberut.l Roach Roth .were on tire, ground, Malcolm being underneath. The defendants were tne worse t'dv drink. Malcolm, -who pleaded not guilty, said in evidence that lie was accosted ’J,y two* high avlio said Jic was tne man who was holding a •‘stake” for them. Uii witness denying any knowledge ol such a thing, iie was tackled by Kichmend. Witness did not know whether lie hit the other man or not. Malcolm was lined Til, and Richmond, uho did not appear, Tij, default being fixed at seven clays’ lmpiisonment in tMiph case. Mr Hone stressed the seriousness of tne olfence, and pointed out that there was no knowing where such an occurrence might lead to. George Henry Kendall (Mr O’Dea) pleaded guilLy lo charges of being found, drunk m High Street, and with wilfully damaging a glass door panel \ahied at 2os, the prooerty of It J) Wilson. Sergeant Henry said that defendant entered the Commercial Hotel at about d. 2- p.m., and called lor a drink. Owing to his drunken condition this uas re I used him, and lie was ordered to leave the premises. Defendant refused tu do so, and he wa.s ejected, but in being lhit out the door lie deLiberittely bi'o-ce one ol the glass door panels. Defendant wa.s a stranger in j“ irill S arrived that afternoon floin Nr-w Plymouth. Mr O’Dea said that -crafenCaut was very drunk at the time, and lie Intel had drink before arriving in Hawera. He wa.s it returned soldier, and had Cecil gassed very badly. He was not a drunkard, but occasionally allowed himsell to 'op. the worse for drink.
