Robert MvGufii:), claiming £35 for a horse bought at an auction sale at Ifawera, was taken on commission, and was to the effect that the horse was bought on condition that it was passed by the Government veterinary surgeon as sound. The animal was sent to Hastings, where Mr M. B.'odie veterinary surgeon, on behalf of Mr McGai'lin, examined it, and declared it to be unfit. The defendant refused to take delivery, and the horse subsequently died. Mr L). Scannell appeared for the plaintiffs, and MrLusk for the defendant.
