A Suit for Maintenance.
(Per Press Association.) Wanganui, August 8. A case of importance and the first of the kind heard in the colony was dealt with by Mr Kettle, S.M., to-day. The case was one in which William Smiley sued the executors of his father's will for maintenance. The information alleged that the plaintiff was destitute, and unable to ' support himself by his own means of «. labor, and that the executors were of sufficient ability to maintain the informant. The magistrate held that it was quite clear under the Destitute Persons Act that the executors were responsible for the support of an applicant if it could be shown he was a destitute person and unable to support himself, and under the special circumstances of the case—informant being a cripple—ordered payment of 15s per week.
