AN IMPORTANT CIVIL CASE

(Per Press Association). Auckland, This day,

An important civil case has been decided in the Supreme Court by Justice Connolly. It was a claim by W. S. Lyell v. A. R. Parrott for £172 8s 2d, calls due on fifty Bank of New Zealand shares sold by plaintiff to defendant.

Mr Cooper, for plaintiff, stated that Lyell sold the shares to Parrot but the directors of the bank refused to transfer them. Lyell had since to pay the calls and he now claimed to recover the same.

The defendant appeared in person and argued that the sale was not completed, the shares not being transferred therefore, as counter claim, he asked for the return of the original purchase money.

Mr Cooper quoted the decision of Justice Williams in the case Forsyth v. Parker, and his Honor gave judgment for the plaintiff, who did not ask for costs.
