The Court of Appeal at "Wellington yesterday afternoon unanimously gave judgment in favor of the defendants in the case of Teira Te Paea and others v. Roer Tarita and another cithont calling on counsel for defendants. The Court held unanimously that the agree-mentof-June 18,1870, referred to in the statement of claim did not constitute Tareta Te Moanunui, a trustee of the Keiwaka block, and that- under the certificate of title and Crown grant afterwards issued he was beneficial owner and not trustee for any person or class of persons under any express or resulting trust or otherwise, howsoever, by virtue of any facts appearing from the statements of claim and defence. In view of this decision it became immaterial to answer the other questions raised. Mr Marsden, for the plantiffs, obtained leave to appeal to the Privy Council on the usual terms.
