Validation Court.

WAIHIN G AHIN G A

In the Validation Court yesterday Messrs H. W. Briggs and W. Ruddick applied for the validation of transfers of the Waihingahinga Block by the several owners thereof. Mr E. Balcombe Brown, of Wellington, appeared on behalf of Mr Briggs and Messrs A. C. Lewis and A. L. D. Fraser for Mr Ruddick.

Opposing the validation, Mr E. H. Williams appeared for Mr W. Robinson, of Te Ante, who claimed to have recently taken a lease of some of the Native interests; and Mr C. A. Loughnan appeared for the Natives. After the case of the applicants had been placed before the Court Messrs Williams and Loughnan raised the point that as the original Crown Lands issued by the Governor contained restrictions against alienation, the Court under the Validation Act of 1893 had no jurisdiction to deal with the application.

This point was argued at great length by counsel for the objectors and applicants, and the Court finally ruled that it had jurisdiction, and that the case appeared to be a particularly proper one for the Court to deal with. Counsel for the objectors then declined to proceed with the merits of objection, and the Court declined to make a decree.
