A otmiovs circumstance is likely to arise from the Bank of New Zealand special enquiry affair. According to a late telegram Mr Law intends to institute a libel action against the Investigation Committee recently appointed by the shareholders, and whose report lately created such a sensation. Mr Justice Gillies is a member of the Committee, and has charge of the Auckland Supreme Court district. In the event" of a libel being instituted against that Committee he would ba one of the defendant!, and the action would be tried in hia own Court. It is not likely to inspire confidence in the minds of the public when we hear of one of our Supreme Court Judges getting himseli mixed up in this way in the affairs of a trading corporation. Hie name being ou the Committee would ol course add

great weightjto any decision which that Committee came to, but hia duty to the public should have induced him to refrain from taking such an active interest in the affairs of a monetary institution. It is said there may be much litigation arise from this Bank affair, and then we shall have the discreditable spectacle of a Judge drawing a very high salary and yet being incapacitated from doing that for which he is paid because he happens to be brought into his own Court as a defendant in a libel action or actions.
