AN INTERESTING CASE.
The case of Colville v. the Union 8.8. Company, in which judgment was delivered for plaintiff, on Thursday, possesses some features which will interest travellers. Two years ago Colville came to Gisborne from Napier and subsequently sent to a friend—McLean—to forward his portmanteau—which contained various articles valued at £2s—on to him. McLean states that he took the portmanteau to the office and left it there ; a man named Quinlan (who was subsequently lost in the Sir Donald) signing the receipt. The portmanteau appeared on the manifest and freight was collected in Gisborne. The portmanteau cou'd not, however, ba found, and diligent enquiries have failed to elicit any information as to its whereabouts. Under the circumstances the freight was returned, but the Company repudiate any liability in the matter. McLean, who had the Company’s receipt in his possession, and had fortunately preserved it, was up country, and therefore the action has been delayed for some time. Evidence in the matter was taken in Napier and Lyttelton. The liability of the Company for the loss is now established.
