Prosecution For Advertising It By Circulars P.A. WANGANUI, May 7 • A plea of not guilty was entered by Bernard Edward McKay, of Wanganui, to-day, when he was charged with sending circulars to Joseph Geoffrey Long, at Palmerston North, and Henry Alexander Hay, at Waverley with an invention to induce them to apply for a “Turf Analysis Service." with a view to obtaining advice for the purpose of wagering on horse races. The Magistrate, Mr. J. H. Salmon, S.M.. reserved his decision. Detective Sergeant. Long, of Palmerston North, said that on April 10, he was on duty at the Awapuni racecourse, where he saw a number of people studying some of which were throwi> away. Other Shlets were placed under the icreen wipers of cars. There was one his car. On the instructions of his superior officer, witness filled in, and posted a coupon with threepence in stamps, and, in return, he received correspondence on a “Turf Analysis Service.” An order form was included which stated that the cost of the service was seven pounds ten shillings. On the pamphlet he had found at Awapuni there were the words; “Those who possess the right information win the largest share of the money in. the totalisator pool.” Similar evidence was given in regard to a pamphlet obtained at Wav-; erley. . , , For the defence, it was argued by Mr B. C. Haggitt that the case must rest or fall on the evidenc/ contained in pamphlets and circulars themselves. They were merely a study and an analysis,,, of the form of race horses, and it. was clear that, bets were to be placed on the totalisator., and not elsewhere,. Counsel quoted a rooming newspaper of May first which had contained “tips” for race meetings that day at Frankline, Dunedin, and Ashburton, although this newspaper did not circulate in those districts.
