YAMASHITA’S APPEAL REJECTED

WASHINGTON, Feb. 4

The Supreme Court has rejected General Yamashita’s appeal. Chief Justice Stone delivered’ a 7,000word majority judgment which declared that the order convening the commission of five generals who tried Yamashita was a lawful ordfir* and the commission was lawfully constituted. The judgment said Yamashita was charged with violation of the law of war, and the commission had authority to proceed with the trial. Yamashita’s petition for review and’ leave to file writs of’habeas corpus was denied.
