BRIEF SITTING AT GREYMOUTH There were no criminal cases before the Supreme Court when it sat at Greymouth yesterday, and the sitting was a brief one. William George Bailey . (Mr J. W. Hannan) petitioned for divorce from Florence Gladys Bailey, on grounds of separation. Petitioner said he was married in February, 1929, and in February, 1938 a deed of separation had been entered into which had been in force ever since. Petitioner’s mother gave corroborative evidence. A decree nisi was granted, to be made absolute in three months. Albert William Bennett (Mr Hannan) petitioned for an order for restitution of conjugal rights against Jessie Ellen Bennett. Petitioner said he was married in March, 1938. He was serving overseas from 1940 till July, 1943? In February, 1944, his wife went to Wellington and he had not met her since. There had been some disagreement about her going to dances without him. He wrote to his wife asking her to return. An order was made for restitution of conjugal rights within 21 days of service of the order.
William Milligan (Mr W. D. Taylor) petitioned for divorce from Jean Milligan on grounds of adultery. He named Morrell Moreton as co-respon-dent. Petitioner said he was married in October, 1917, in Scotland, and came to New Zealand about four years later, living with his wife at Millerton. There were no children. In August,' 1932, his wife went to Greymouth for a holiday. She had been friendly with a man named Morrell Moreton, who left Millerton at about that time. He could not. find his wife, but ultimately she and Moreton were located at Auckland. In January last he visited Auckland with his brother and found Moreton and his wife, who admitted that they wese living as man and wife. Hugh Fulton Milligan, petitioner’s brother, gave corroborative evidence regarding the visit to Auckland. A decree nisi was granted to be made absolute in three months, corespondent being ordered to pay petitioner’s costs on the high scale as in an undefended suit.
