Cassidy was injured in an accident at the Walisend mine in January, 1942. His Honour, in giving judgment, stated: “Having regard to the medical evidence, the Court must award substantial compensation, in that the severity of the injuries received is agreed upon, and even Dr. Bird, who stresses particularly the neurasthenic factor, thinks that the injured arm will be precluded from heavy labour.” Seventy-two weeks had elapsed since the accident, and thus the remainder of the period of lability was 241 weeks. Usually the Court allowed three months’ total disablement for neurasthenia, but, having regard to the physical injuries, he had decided to allow one year in addition, making a total of 65 weeks, with 50 per cent, of full, compensation for the remainder of the period of liability. Accordingly the amount payable, in addition to full compensation for 72 weeks, would be 241 weekly payments of £1 18s Bd, £415 11s 6d; 65-weekly payments of. £1 18s Bd, £l2l 15s 3d, making a total of £537 6s 9d.
