Turley, owner of Lough Derg, against the decision of the New Zealand Trotting Association in disqualifying her horse for the Dingers’ Trot at the Kumara Racing Club’s meeting on April 14, 1941, on the grounds that such horse started in advance of its proper mark, was heard last week before the appeal judges. Messrs D. E. Wanklyn, G. W. C. Smithson, and A. L. Mat-

son, and the following decision has been announced: — “Having herd Mr F. L. Turley, appearing as agent for Mrs V. E Turley, the appellant, and Mr R. A. Cuthbert, appearing as counsel for the Trotting Association, and having read the evidence and statements submitted to the sub-committee of the association, and heard additional evidence tendered on behalf of the appellant, the judges are unanimously of the opinion that the evidence is not sufficient to convince them beyond reasonable doubt that the horse Lough Dergh started in front of its proper mark in the Diggers’ Trot Handicap at the Kumara Racing Club’s meeting held on April 14, 1941, and that therefore the appeal be al-1 lowed.

“The judges are furtaer unanimously of the opinion that the procedure adopted by the association for conducting the original inquiry was correct and strictlv in accordance with the rules. The judges direct that the deposit lodged by the appellant be returned.” TROTTING APPEAL CHRISTCHURCH, Sept. 16. The appeal judges cf the N.Z. 'Trotting Association, Messrs M. G. Louisson, G. V/. C. Smithson ’and Allan L. Matson to-night dismissed an appeal by the Forbury Park Trotting Club against the decision of the N.Z. Trotting Association in allowing the appeal of Mrs E. R. Baldwin.
