WESTPORT NOTES

(Our Own Correspondent). Magistrate’s Court: WESTPORT, October 4. Before Mr 11. Morgan, S AL, yesterday, William Forsyth and John Quripal were eached lined 10s with costs 12s and solicitor’s fee 10s 6d for allowing stock to stray on a country road. A;young man,'a member of a highly respected family, was charged with the theft of a Mickey Mouse mascot, the property of the Ta rata Hockey Club. which recently visited WestpoiC. Mr Pcully for the defence, teferred I the charge ns trivial, and one that he did not think was a credit Io the pro ecut'ion. The mascot was handed round at a dance and i't came into possession of defendanit who took it home, intending to return it next day. The Magistrate, in convicting and admitting accused to probation for a period of six months, said it appeared ito him on the evidence, that there was an intention to steal the mascot.

Win. Nicholson, for whom Air Al. B. Scully, appeared, was charged with assaulting Mrs Norah Corcoran. who was represented by Mr 11. Lovell, at Granlty. Defendant was working on a drain fronting the residence of Air Corcoran and the latter objected to Hie depositing of the mud near her gate. It was alleged by plaintiff that when she remonstrated with Nicholson he hit her with a shovel he was us'ing. The Magistrate, on hearing the evidence, dismissed the informal ion.

Arising out of the above ‘incident John and Thcmas Corcoran were charged with assaulting Nieho’son. Mr Alo’ony appeared for defendants. William Nicholson, in evidence, said he was clearing a drain near Corcoran’s. Mis Corcoran protested against the mud and an argument followed. She 'oft. and soon after ithe two defendants arrived on the scene. They assaulted him a .nd he suffered an injury to his ear. Defendants were convicted and fined £5 each with witnesses’ expenses £3 5s 6d between them. Default was fixed at one month’s imprisonment in Grey mouth ja'il. The adjourned case of John Benneitt (Mr Al. B. Scully) versus the Trustees of Stockton Sick Benefit Fund, was resumed. The plaintiff claimed he was entitled to benefits from the sick fund and defendants maintained that an amendment ito the rule?* debarred him from receiving further assistance from the fund. The case was adjourned last Court day for the production of the minute book rci/.rding the alteration to the rules. After hearing evidence rhe Ata gist rate said that he had given the case a lot of consideration and although of one irwind at 'the adjournment. had since the production of the minuter put a. different interpretation on ithe rules. Air Scully’s interpretation might easily Vo taken as the correct one. but he would rule otherwise. Under the old rules, after a lapse of 12 months, Bennett would be enabled to come back to benefit on November 4 but a fortnight before an amendment had been passed debarring him. in that it stipulated that six nionth? must be worked before a benefit could be accrued. I't was unfortunate for Bennett thait the rules had been amended as he was due to come back nn benefit. The rule, however, was a sound one and should benefit a greater "umber of members. Judgment was accordingly given for defendants. Body Not Yec Recovered:

Searchers continue in itheir efforts to discover ‘the body of the late Air Marshall, who met with such a tragic end on Monday last.
