Application . was made before Mr Justice Sim to-day for a stay of execution of the writ of discovery in the case*of the Crown v. Merchant's Association; Under the Commercial Trusts Act the Association claimed the right to seal up parts of the minute book dealing with matters other than sugar; but the Chief Justice had ruled that the whole must be produced. . In favour of the present application for a stay of execution, it was emphasized that the Court had always maintained the sacredness of private -rights. Defendants had the right of appeal, therefore the right to stay of execution. The possibility of an order for discovery leading to' further prosecutions (lie did not say that it would) \yas a grave reason why the Association should have the right to appeal. The Solicitor General said it might be: that a stay of .proceedings would paralyse the force of justice. . Argument is proceeding.
