The Court of Appeal was engaged all day in hearing the appeal in re the Midland Railway Coy over the decision of the Chief Justice and Mr Justice Edwards dismissing a petition by the debenture holders of the Coy for an order for the sale and possession of the railway. For the appellants it was argued that the debenture holders- had a first charge on the assets of the Coy. The Crown, however, claims that the right of the debenture holders are subordinate ' to its rights under the contract with the Coy and that the line cannot be sold in parts. The court reserved its decision.
