WHEREAS under the authority of "The Salmon and Trout Act, 1867 n (hereinafter termed " the said Act "), certain, regulations ware made for the said Aot, and published in. the New Zealand Gazette of the thirtieth day of September, one thousand eight hundred and seventy seven, and such regulations are now in force : And whereas by the said Aot it is, among" other things, enacted that it shall be lawful for the Governor, from lime to as may become necessary, to make such regulations as to the Governor seems expedient, forim posing or prescribing any conditions abd restrictions in respect to salmon or trout fishing : And whereas, for the purpose f protecting salmon, it is expedient that additional regulations should be made as hereinafter provided: And whereas certain regulations were made for the purposes of thn»aid Act, and published in the Government Gazette of thethirtieth day of January, one thousand eight hundred and seventynine: Now, therefore, L Sir Hercules George Robert Robinson, the Governor of the Colony of New Zealand, in pursuance of the; hereinbefore recited power and authority,: and of every other power and authority enabling me in that behalf under the said Act, do heieby revoke the said last-mentioned regulations published on tbe said thirtieth day of January, one thousand eight hundred and seventy-nine, and further do make the following regulations, that is to say, — 1. If any person shall by any means take or catch any salmon in any stream, river, or I tidal water, he shall forthwith return such ! salmon alive to the stream, river, or tidal ! water in or from which the same was caught or taken. Any person knowingly and wilfully committing a breach of this regulation shall be liable to forfeit and pay snob, aum o money, by way of penalty, not exceeding one hundred pounds, as the Justices imposing such penalty shall think fit. The expression "tidal waters" has the like meaning as given to such expression in certain regulations made under " The Fish Protection Act, 1877," and published in tbe New Zealand Gasette of the eleventh of April, one thousand eight hundred and seventy-eight. 2. No person holding a license issued under the said last-mentioned regulations shall be deemed exempt from these or any other regulations in force under "The Salmon and TrontAct, 1867." 3. These regulations shall be read as part of any existing regulations for the time being in force under the said Act, and whenever any penalty shall be prescribed under any regulations in force under the said • Act as aforesaid, it shall be lawful for the Justices imposing the same to order such part of the prescribed penalty to be paid as the Justices before whom the same shall be sought to be recovered shall think fit As witness the hand of His Excellency the Governor this sixth day of May, one thousand eight hundred and seventynine.
