SUPREME COURT.
CRIMINAL SITTINGS. Monday, October 12. [Before his Honor Mr Justice Gresson.] [The following is the conclusion of the case Regina v. F, Peiper and G. Doig, for larceny, which took place after we went to press yesterday.] Henry Jeffrey gave evidence as to the delivery by him of the soap at Wilson’s tannery under direction of the prisoner Doig. Thomas Wilson was the next witness, and detailed the circumstances of the prisoner Peiper agreeing with Mr Howard to supply soap and the delivery to him of it. John Charles O’Neill, a youth in the employ of prisoner Peiper, deposed to both prisoners sleeping on the premises on the night the soap was missed.
John Howard deposed to the purchase of one ton of soap from prisoner Peiper on account of Thomas Wilson, only a portion of which had been delivered. This closed the case for the Crown. Mr Joynt intimated that he did not intend to call any witnesses for the defence. Mr Duncan addressed the jury for the prosecution. Mr Joynt then contended that there was no evidence against Doig to go to the jury.
His Honor agreed with this view, and directed the jury to return a verdict of acquittal, which was done. Mr Joynt then addressed the jury for the prisoner Peiper. The jury then retired, and after a short absence, returned a verdict of Not Guilty. The prisoner was then discharged. SENTENCES.
George Hendley and Charles Weed, who had been convicted of sodomy, were brought up to receive sentence.
His Honor sentenced each of them to two years’ imprisonment with hard labor. The Court then adjourned till the 19th instant, at 11 a.m., when the civil business will be taken.
