PLAJNTJ.F NON-SUITED ALLEGED NEGLECT OF FARM 'Press Association!. WELLINGTON, July It. "Without calling on the delenee to give evidence, Mr Jusirce Smith, after a five-day hearing in the Sup erne Court, non-suited with costs, upprox’mating £BOO. Norman Heaton Pike, of Auckland, in his claim against David James Richards, of Wellington, retired professor, and Roy Nathaniel Barton, of Feathc-ston. sbeepfanner, respectively., third and second mortgagees of a Wairarapa property named Bank View, which Pike owned, subject to a, mortgage to both defendants as mortgagees in possession.
Pike claimed £4OOO for alleged neglect, £1250 for occupational rent and an -order for accounts. Aga-.nst Richards alone, lie sought £2BO damages for an alleged forced sale of stock and an order declaring null and void an agreement of June 4. 1935 transferring his interest in Bank View to- Richards, and an -order for the) delivery or the cancellation of the transfer of the property.
