King);ford Smith’s attorney and 1 counsel for Mr Cation. “Smithy” admitted that Mr Cation bad an agreement to act as, the promotor lor himself and Mr Ulm in 1928, but-.de-clared that Mr Catt-on tailed c°m])lctc,!y in Ids effort's: to linance the flight, and thus has no claim against him. «
Air Catton charged that he spent! 750 dollars on behalf of ‘Smithy’ and askU for an additional 1000 dollars for his services.
The issue is expected to come to
a -speedy tria£/ The aviator, speaking of his intention to fly hack to Australia via the East, said:
' “l shall fly 17,090 miles. to Australia this time. This will be ono of the longest flights in the history of aviation. I wcu-bj much prefer to make my wav homo by boat in a leisurely maimer, but plans have just about materialised for me to liy from IMs Angelos to New York, thence to London, and from there to Australia.
Sir C. Ivingslord Smith to-day boarded the exploration cruiser Velcro 111., owned bv Captain G. Allan Hancock, a wealthy oilman and explorer, who financed the 1928 flight. “Smithy” plans to rest aboard the cruiser for several days.
