At the hearing some, of this .evidence was admitted and some excluded’ by ti e trial judge. The jury were unable to agree upon Mu* verdict, and a now trial was ordered. It is sought to obtain a ruling of the Court of Appeal' on the admissihilitv of the evidence before the second trial is instituted. Decision was reserved.
