Continuing his argument, counsel for Holmes isubmitfed that although the insured had sustained a loss at Hie- moment of the accident, iiR right to indemnity and liability upon the unUerwriters did not arise till the car was actually repaired. I.u Ibis case the damage could not, under tlii* circumstances, be repaired, and the partial ..damage was merged in ■subsequent total destruction. Furthermore, the underwriters were niidcr no liability because when the loss occurred there had been no {‘lection to pay instead of repair. The court reserved decision.
