PRINCIPLE AT ISSUE

Immediately after the Easter vacation the Gisborne Harbor Board’s application for a declaratory .judgment as to whether or not the board can- raise between £30,000 and £ f-0.000 required to complete the harbor works, in view of its moral obligation not to raise more than £750,000 without consulting the ratepayers, will come before the Supreme Court in Wellington. Air Al. Alyors. K.C., of Wellington, has. been retained by the hoard' ru support of the application and he Avill have with him AFr H. D. Chrisp, of the board’s legal advisers. The question .was raised at the board mooting yesterday, whether in event of the board requiring more than £40,000 to finish the undertaking the authority could he obtained.

Tlie secretary (Air Barton) replied that the board’s solicitors considered that the court would give judgment on the manciple of whether or not the board could, raise the required money without reference to the ratepayers and would probably not stipulate' any sum.. He expected that tlie board would require nearer £50.000 to complete the harbor.
